Governing Law and Jurisdiction

These Terms and Conditions, your use of this Website, and any purchase transactions conducted through it are governed by, and must be construed in accordance with, the laws of New Zealand. By accessing or using this Website, you irrevocably agree that the courts of New Zealand have exclusive jurisdiction to hear and determine any dispute, claim, or legal proceedings arising out of or in connection with these Terms and Conditions.

Limitation of Liability & Installation Disclaimer

To the maximum extent permitted by law, EVOAQ (EvolutionFX Ltd) shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use, misuse, or improper installation of our products. It is the customer’s sole responsibility to ensure that all electrical products are installed by a licensed, certified professional in accordance with our product manuals and local New Zealand building codes and regulations.

Website Accuracy

While we endeavor to keep all product descriptions, dimensions, and specifications accurate, we do not warrant that the information on this website is error-free, complete, or current. Product images are for illustrative purposes only, and actual product aesthetics or packaging may vary slightly.

Pricing and Payment Terms

All prices listed on this Website are in New Zealand Dollars (NZD) and include Goods and Services Tax (GST) unless stated otherwise. We reserve the right to correct any pricing errors or inaccuracies on the site at any time. In the event an item is listed at an incorrect price, we reserve the right to cancel any unfulfiled orders placed for that item and issue a full refund.

Shipping and Delivery

Many EVOAQ products are custom-assembled in-house to order. Consequently, a variable lead time applies to all orders, with a minimum processing and assembly window of 2 to 3 working days prior to dispatch.

Dispatch Estimates

While we aim to fulfil and dispatch all orders within 5 working days of payment confirmation, this timeframe is a target and cannot be guaranteed. We are not liable for any financial or operational losses caused by fulfilment delays.

Courier Transit Guidelines

Once dispatched, orders are handed over to third-party courier services. Estimated transit timeframes are guidelines only and may fluctuate based on carrier capacity, routing disruptions, or seasonal demand:

    • North Island: 1 working day from dispatch.
    • South Island: 2 working days from dispatch.
    • Rural Delivery: Please allow 1 to 2 additional working days on top of standard transit times.

    Transfer of Risk

    Risk of loss, theft, or damage to the goods passes to you immediately upon the courier tracking showing the parcel as successfully delivered to your specified delivery address.

      Refund and Returns

      Our refund and returns policy lasts 30 days. If 30 days have passed since your purchase, we may not be able to offer you a full refund or exchange. Please note that this does not apply to returns for warranty reasons – please refer to our warranty policy for warranty returns.

      To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. To complete your return, we also require a receipt or proof of purchase. Please do not send your purchase back to the manufacturer without being instructed to do so.

      There are certain situations where only partial refunds may be granted:

      • Any item not in its original condition, is damaged or missing parts for reasons not due to our error.
      • Any item that is returned more than 30 days after delivery

      Refunds

      Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

      If you are approved, the email will include a request to confirm any details required for the refund to be processed. The refund will then be processed within 7 days of the confirmation of payment details. Please note it may take 1-2 days for the refund to appear on your bank statement depending on which bank you are with.

      Late or missing refunds

      If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted.

      Sale items

      Only regular priced items may be refunded. Sale items cannot be refunded.

      Exchanges

      We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at sales@evoaq.co.nz and send your item to: Unit 28, 375 East Tamaki Rd, East Tamaki, Auckland. Please do not return items without contacting us first and being instructed to do so. We do not accept responsibility for returned items going missing if you returned them unprompted.

      Shipping returns

      To return your product, you should mail your product to: Unit 28, 375 East Tamaki Rd, East Tamaki, Auckland.

      You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. Depending on where you live, the time it takes for your exchanged product to reach you may vary.

      If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

      Product Warranty

      All EVOAQ products are supplied with a minimum 3-year voluntary manufacturer’s warranty from the date of purchase, unless specified otherwise in writing. This voluntary warranty covers parts and manufacturing defects only. It expressly excludes labour costs, travel expenses, freight charges, and installation consumables (such as duct tape, cable ties, or screws) required for the removal or reinstallation of components, except where required by law.

      Consumer Guarantees Act (CGA)

      Nothing in these Terms and Conditions or the specific EVOAQ Warranty Policy is intended to exclude, restrict, or modify your statutory rights under the New Zealand Consumer Guarantees Act 1993. If you are acquiring goods for personal, domestic, or household use, our products come with guarantees that cannot be excluded under consumer law.

        Commercial Purchases

        If you are acquiring the goods for the purposes of a business or trade, you agree that the provisions of the Consumer Guarantees Act 1993 do not apply.

        Communications

        Transactional Communications

        By making a purchase or creating an account on this Website, you agree that we may send you functional electronic messages. These include, but are not limited to, order confirmations, tax invoices, shipping and tracking updates, payment inquiries, and critical product safety or recall notices. Because these communications are necessary to fulfil our service obligations and ensure customer safety, they are not subject to standard marketing opt-out requests.

        Marketing Communications

        We will only send you commercial marketing messages, including product care alerts, promotions, and newsletter updates, if you have provided explicit opt-in consent at checkout or via our website forms. You may revoke this consent at any time by clicking the unsubscribe link at the bottom of any marketing email or by contacting us directly. Unsubscribe requests will be processed within five working days.

        Privacy and Personal Information

        Your privacy is important to us. Any personal information you provide to us through your use of this Website or during the order process will be collected, stored, used, and disclosed in strict accordance with the New Zealand Privacy Act 2020 and our comprehensive Privacy Policy. By accepting these Terms and Conditions, you also acknowledge that you have read and understood our Privacy Policy, which outlines how we protect your data, manage website cookies, and process your personal information.

        Intellectual Property (IP)

        All content included on this Website—including text, graphics, logos, product descriptions, images, digital downloads, and instructional manuals—is the exclusive property of EvolutionFX Ltd and is protected by New Zealand and international copyright laws. You may not reproduce, copy, or distribute any content without our express written permission.

        Amendments to Terms and Conditions

        We reserve the right to amend, update, or replace any part of these Terms and Conditions, including our policies, at any time and without prior notice. Any changes will take effect immediately upon being posted to this Website. It is your responsibility to check this page periodically for updates. Your continued use of or access to the Website following the posting of any changes constitutes your binding acceptance of those modifications. The Terms and Conditions in effect at the time you place an order will govern that specific transaction.
